While this story deals with the context of Calgary Police it really extends to all law enforcement arms and branches of methods of operation within the lawful search of suspects.

With that in mind, hacking of computers by law enforcement – direct or indirect should be in the same vein as those requiring wire tap warrants. Then a judge can decide if there is merit in the request.

A judge does not need the technical details in either case unless there is a question of the lawful method of such searches.

There was a reason put in place for wiretap warrants and it is no different for computer interception of data and hacking.

And of course… this extends to the federal level especially spy agencies. The law remains the law of the land.

It is a democratic right to have things explained were there is a need for both sides of an open society.
