A few days late, but better than never.
The ‘problem’ as I see, hear and understand is ‘WHO’ pulls strings behind the scenes in sentencing arrangements. Those carry the weight of Social Engineering based on evidence.
Mandatory sentences would be meaningless if used as gauges simply as a means to lock up individuals. You would in theory get minimum for far worst based on evidence.
Here is the problem.
A few days ago on The National, operation snapshot allowed journalists to tag along. On the surface all is kosher. The news story indicated that a search warrant for evidence was issued AFTER collecting evidence. Evidence that in my opinion used many tactics that were NOT in all probablities compliant with laws. The search for evidence was done prior to the search warrant.
What we end up with is wasted efforts to find culprits only to lose them in a system and end up with 2 year sentences.
I’m willing to bet that had all the dirty tricks of Social Engineering had found a sliver of evidence in my custody of kids, I would have been locked up for a minumum of 25 years. Dirty CAS tricks are in large part the problem. Judges rely too much on a seriously flawed organization.
