I’m in full support of repeal of these laws. Unconstitutional.

Governments have no moral/ethical right under the highest order to seize properties.

Laws of these types are akin to God kicking humans off the planet for being immoral in nature, unable to be the example of good stewardship of it’s resources and exploitation of them.

But…. that gives me an idea. Ha ! Come to think of it, maybe we are in the same business afterall.

You can punish for criminal acts, seize property only in the rare exception where there is such a visible transparent effort to displace/replace lawful governance in order to maintain peace, but to arbitrarily take possession under the guise of proceeds of crime leads down the same roads as all other laws that is contrary to the public trust of governments.

When it is absolutely clear beyond the shadow of any doubt that a crystal clear connection between business gain of huge proportions based on a reasonable conduct of lifestyle of similar natures of other businesses or people is disproportional when compared, then and only then should excess be seized by the state and redistributed back into the public domain in such a manner as the profit of assets are returned to government and law enforcement agencies to recoup their costs of law enforcement. A normal amount of property or assets can be retained for an individual as the carrot and stick model target once incarceration is finished. This helps insure that an individual works in tandem with correctional intention for the good of the whole and does not become depend or lean back towards crime in the future upon release. Work out the details from there…..

The question really amounts to the line in the sand argument. Indiscriminate seizures are not legal.

Why – because it is subject to the current opinion of one or a few persons making judgement calls on the basis of their own interests only and to profit from it.

Incarceration and correctional behavior is punishment enough.

Eventually when states seizes everything because it considers every citizen a criminal, you end up with anarchy and states of war – civil disobedience and then leading up to international conflicts.

This includes annexation without representation and city states or provinces and states unilaterally declaring themselves independent and separate entities from a unified whole.

The main difference lies in the size of decision makers and what they declare themselves able to do without justification using laws or notwithstanding clauses as workarounds.

Imagine for a moment 51% voting in favor of separation. Wouldn’t that be a thrill to watch the results ! Tell me there’s no profit in making and taking such a decision and I’ll tell you flat out that it’s a lie. Megabucks at stake.

It always boils down to money and power. Abuse one, the other follows – like Masters and Slaves.
